All the Blogger Fraternity,
I am at pains to explain whatever sad state of affairs I have observed.
Look, as officers we were always Non-Caring, not bothered and almost ignorant of what we should be getting and what our men under our command must be getting. Any one talking about these including our higher ups were frawned upon as "Baniyas". There was a faith and unsuspecting environment in the Armed Forces that the Accountant in CDA will interprete the rules for you and whatever he does is the best.
That faith and ubderstanding prevailled upto the highest echleons of the Armed Forces including amongst successive Chiefs and hiher leadership. IAS in MoD knows much more and better than them and what ever he was doing was in the National interest and better for the Armed Forces and the Country.
It is very unfortunate, sad, bad and unforgiving that the IAS lobby and the accountants of the IDSA took all advantage of the faith and successively betryed the faith. The situation todya is "Every thing they do is bad".
After all who has been responsible for this loss of faith and unresolved Confrotatation. I would say both, our higher echleons as also MoD parafernalia. The compulsions of "Competetive Bueracracies" must have been well understood by our bosses who caved in at all stages unsuspectingly or because of share incompetence.
At the ground level, we as officers are supposed to know and find out each and every thing about the Pay, perks and entitlements of our men we command first and then about ourselves. Calling someone a "baniya" because one cares for his entitlement is sheer absurdity and wrong attitude. In fact neglecting that is sheer negligence.
I am rudely surprised to find out the level of ignorance amongst serving AF officers as also the Retired ones about Rules and Regulations governing them includin Pay and Perks. If an officer does not know it, he has no right to command.
We ourselves have provided opprtunities for our own downgardation. We are not firm because we are oblivious of knowledge of Rules and Regulations. We are not firm as to we have doubts about our place in the system and then in darkess we waver. Lack of firmness is due to our lack of knowledge and Competence.
So before Service officers blame others, they must improve on their knowledge. How many of you have taken on CDA (O) and confronted his staff and you are right and He is wrong. How many times has an officer bullicked a PAOR official for delay or wrong remittance to his company personnel.
If you can do it why crib. I know that firing the gun correctly is your priority, but welfare of your men (including his pay and perks) is eqaully your prime duty. One takes that oath while passing out.
The IAS in MoDand the IDAS men need to rubbed with their own salt. That salt happens to be Rules and Regulations. It is incumbant on all officers to know it better than others.
Please do not ask childish question which reflect very poorly on you. That shows where the root cause ouf exploitation of AF officers lie.
You all want to be equatted with IAS and IPS, well then prove worthy of it, at least at awareness level. If a DC starts banking on his PA (or his Company Clerk), well he will be out in five days if not less.

It is very easy to use common jargons and steer away from truth. For example, reg revsion of pay scale of Lt Gen., it is stated:
" (iii) Revision of Lt. General Pension after carving out a separate pay scale for them.
[These proposals emanate from Sixth CPC’s Report and are to be implemented w.e.f. 1.1.06)"
We are all at a loss to know wherefrom such a proposal emanated? In fact any such proposal was buried deep by the very pay commission in one of its recommendations to include the concerned scale of pay S30 in a Pay Band along with other lower scale(s).
There should be a sense of responsibility and acountability with respect to correct INTERPRETATION and IMPLEMENTATION of the SCPC's recommendations in letter and spirit. If this had been done, many of the problems could have been tackled/resolved "HONESTLY" and "OPENLY".Now devious DIVIDE & RULE / BACK-DOOR/ BEHIND THE SCREEN methods are being adopted to wriggle out of "FORCED" situations!.

HI all SNCOs . we have been denied our status as SNCOS by the arbitary action of the 6cpc of dumping us in PB 1.This action by 6cpc and subsequent approval by GOI has caused wide spread heartburn among the sergeants of the IAF and equi.in other two services. the railways and some other ministries have already rectified the anomaly but the MOD is yet to respond.so I enjoin upon the GOI MOD to take a favorable decision in tis regard to keep the SNCOS morale up.sergeants of group x had a starting asalary of 5000 in the old scale and on multification by 1.86 [the pay commision factor] will surely place them in PB-2 by all means.The rational under this assessment by the 6 cpc is not understood as most of the sergeants are skilled workers with around 10 years of service. Normally they are equated to ASI of police and junior engineers [diploma] in the civil parlace.Now the dcision to dump them along with the lowest pay band warrants urgent rectification. The million dollar question is how can a soldier who is employed in manitenance of sophisticated aircrafts, missiles , and submarines be dumped in PB-1. THERE IS WIDESPREAD RESENTMENT among the serving as well as retired SNCOs in the matter as can be seen from the comments in almost all defence related blogs.I would like to exhort all ex. org. if they are worth their salt to take up the issue at appropriate levels

PLIGHT OF PBOR PENSIONERS : POST 01 JAN 2006
1. One year has passed since the implementation of the 6th CPC. When the 6th CPC recommendations were implemented, the Services HQ has raised four issues as major anomalies concerning Defense personnel. Three issues were related to the Officers regarding enhancement of pay and grade pay and one was related to PBOR regarding restoration of extant pensionery benefits reduced by the 6th CPC.
2. Now is the time to take stock of all the above four issues. All the issues pertaining to Officers have been resolved and necessary notification issued. But the only issue of PBOR which was just to maintain the status quo regarding pension fixation formula is still pending. There was a lot of hue and cry and MOD officials were being blamed for causing the delay till the issues of Officers were not resolved. But once the notification of placing Lt Cols in pb-4 and granted hag to Lt Gens issued, all voices fell silent. Nothing has been heard regarding enhancement of PBOR pension. It seems that the inclusion of PBOR pension issue was only symbolic.
3. Various news agencies have reported during Sep 08 that the Govt has agreed in principle for granting extant pensionery benefits to Jawans as hitherto. But even after one year Jawans are waiting the notification of pension table.. It is still not known as to what is stopping mod in notifying pension table when the same has been accepted one year back. We are not worried on the part of mod for causing this inordinate delay but are disheartened to see that officers class is silent on the issue.
4, When all the Central Govt pensioners are getting their enhanced pension as per 6th CPC since Sep 08, lakhs of armed forces Jawans retired after 01 jan 2006 are still getting pension as per old scales ie. as per 5th CPC. Even the banks are not granting them DA since last year on the plea that the current DA is on the revised rate of pension whereas pension of Jawans retired after 01 Jan 2006 is still on the old scale. Pensioners of all other Central Govt departments will get their complete arrear since 01 Jan 2006 by the end of this month, but for the Armed Forces jawans who retired after 01 Jan 2006, leave alone the arrear , they even don’t know what their pension will be. Have the officers accepted such treatment if meted out to them?
5. Even on the OROP issue nothing has come out in black and white as yet, still voices are being raised to stall its notification saying that it pertains to Jawans only. Officer’s contention is that Jawans and officers be counted as one category for grant of OROP. The main plea behind grant of OROP is early retirement. Officers start retiring after attaining the age of 54 whereas majority of the Jawans retire before attaining the age of 45. Furthermore, pension fixation formula for Officers and Jawans is different. However, all will be happy if Offrs also get OROP. But, instead of projecting their case only, Offrs should show sensitivity to the issues of Jawans also.
6. As per the 6th CPC pay band , a washerman, safaiwala, cook, mess waiter of the same rank will draw the same pay as a clerk, storekeeper, tech pers , inf soldier and even AEC instruction in gp ‘y’. It is not that tradesmen should get less pay but the point is that the pay should be fixed as per the nature of the job and qualification attached to the rank and trade. Further, all officers pick up the rank of Lt Col on completion of 13 years of service and placed in PB 4, whereas majority of the Jawans enrolled as Sepoy remain HAV till 24 years of service and remain in same PB 1 for 24 years. Still, these issues don”t merit consideration
7. So, it is time that issues of Jawans be addressed in true spirit and MOD be expedited to issue necessary notification of pension table as the Jawans who have retired after 01 Jan 2006 and still retiring have already incurred huge financial loss on this count, as their commutation of pension is also held up.

GUIDELINES : COMPLAINTS ON PENSION PROBLEMS/GRIEVANCES TO PCDA(P) ALLAHABAD
All Veteran Brothers are hereby informed to follow the undermentioned guidelines while petitioning their complaints on pension matters to PCDA(P) scrupulously:-

Complaints.
1. If you want to represent any problem to the office of PCDA (P) please furnish following information/particulars along with full details of your problem/grievance.
(i) Your name, Regt. No., Record Office/H.O.O. from where you retired.
(ii) P.P.O,. No. and date under which the pension was granted in your favour
(iii) Name of the P.D.A./Bank from where you are drawing your pension with saving bank/current account number.
(iv) TS/PS/HO number allotted to you (incase of DPDOs, Treasuries, Post Offices and PAOs).
Arrear of Pension:-
1. Pension undrawn for more than one year becomes time barred, which is paid only after sanction of the Competent Authority i.e. TO/PAO/DPDO. In the case of PSBs, the arrear claim on the prescribed form should be submitted to the bank to enable them to obtain the sanction of PCDA (P) Allahabad/CDA Chennai/CDA (PD) Meerut.
Joint Notification of Family Pension:-
1. The widow in whose favour the pension has been jointly notified should report the death of her husband to the P.D.A. and submit the death certificate to enable him to commence payment of family pension from the date following the date of death of her husband.
Nomination for LTA:-
1. Pensioners are advised to nominate their families in whose favour family pension has been jointly notified to enable her to receive lifetime arrears in case of his death. In case his wife is not alive he should nominate other members of his family to avoid inconvenience in obtaining Life Time Arrears by the Legal heirs.
Certificates:-
Submit periodical certificates regarding re-employment/ employment/ earning widowhood to your P.D.A. on due dates in order to regulate your pension correctly.
Physically Handicapped Mentally Retarded Children:-
1. If you have any physically handicapped/mentally retarded child, you may apply to your HOO/RO/Army Hqrs. for making an endorsement in your service & pension record and keep the acknowledgement of this intimation.
RSMB:-
1. You are advised to appear before the Re-Survey Board on due date as arranged by the Record-office. In case you fail to appear before R.S.M.B. for a long time, submit delay explanation alongwith non conviction and non-reemployment certificates to the R.O. for arranging a fresh R.S.M.B.
Rejection of Dis. Pension:-
In case disability pension is rejected, you may make an appeal to the Govt. of India within 6 months through Record Office, if you feel that the disability in your case is due to service factors. Similarly family of the deceased can also make an appeal, if the claim for special family pension is rejected.
Family Members:-
1. If a pensioner has married after discharge or has children born after discharge, or wife/children have died report the matter with full details and certificates (birth/death/marriage/remarriage) to Record Office/Head of the Office for record in Kindred Roll portion of Sheet-roll/Service Book in order to avoid any difficulty in the event of need.
2. If joint notification of family pension has not been done in your case, apply to your P.D.A. on the proper form to enable him to process the joint notification of F.P. through R.O./H.O.O., A.H.Qrs.
Two Pensions:-
If a pensioner is in receipt of more than one pension, he should furnish full details to the P.D.A. for revision of both the pensions and regulating dearness relief on both the pensions
Restoration of Commuted Portion of Pension:-
1. Commuted portion of pension will be restored by the P.D.A. on his own without obtaining any order from this office after obtaining requisite application after 15 years from the date of first payment or from the date pension was reduced in case of subsequent commutation. Convicted Pensioner:-
If a pensioner is convicted or sentenced to imprisonment by a Court, his pension will be suspended. He should submit the copy of the Court order to the PDA to enable him to report the matter to this office for obtaining the orders of the Competent Authority. On release from the Jail he should report the matter to the P.D.A. and submit the requisite documents to enable him to refer the matter to this office for obtaining the orders of the C.E.A. for restoration of his pension.
Annual Identification:-
1. A life certificate is required to be produced by the pensioner, who is unable to appear due to bodily illness or infirmity and desires payment through a representative once in the month of November each year.
2. Pensioners who are receiving payment from PSBs and D.P.D.Os should appear before the P.D.A. once each year in the month of November for identification
Court Attachment:-
1. No pension whether due or to become due can be attached by process of any Court until it has actually been paid as per pension Act XXII of 1871.
2. No pensioner can assign or sell any interest in respect of the pension not then due.
Insane Pensioner:-
1. If a pensioner becomes insane, his dependents should obtain a certificate from the Magistrate and produce the pension certificate and life certificate for drawing pension. If the pensioner is lodged in an asylum the cost of pensioner's maintenance will be paid by the dependents to the asylum authorities as per orders of the Court on an application by the asylum authorities under the provisions of section 25 of Lunacy Act.
Payment of Dearness Relief:-
Group 'A' officers are not entitled to dearness relief during re-employ under a Govt. office/company/Corporation/Undertaking/Autonomous body. PBORs are entitled for dearness relief during re-employment under above organizations subject to production of a certificate from his re-employer that his pay has been fixed at the minimum of the scale of the post on which he has been re-employed and his entire amount of pension has been ignored in fixation of pay on re-employment. Drawal of Pension Through Agent:-
Pensioners who desire to draw pension while residing outside India may open a non-resident account in any of the Scheduled Public Sector Banks in India. He should execute a power of attorney in India before proceeding Ex.India on a non-judicial stamp paper or on a plain paper affixed with adhesive stamp paper of appropriate value, before the Notary Public or any Magistrate. The pensioner shall furnish life certificate once a year through High Commission/Embassy of that Country where he/she resides. If he has changed his nationality in Country other than South Africa and Israel. Sanction of this office will be required through his P.D.A. for continuation of his pension.
Release of Withheld Gratuity:-
1. The withheld amount of D.C.R.G. is payable after six months from the date of retirement without any authorisation from this office.
2. If a pensioner desires to get his pension account transferred from one P.D.A. to another in India, he is required to submit an application to his present P.D.A. No application is required to be submitted to this office. Transfer of pension accounts outside India is not permissible.
Commutation of Pension:-
Commuted portion of pension is required to be reduced from pension from the date of payment or after 3 months from the date of issue of P.P.O. and in the case of P.S.Bs from the date, capitalised sum is credited to the pensioners' account. If the commuted portion of pension is not reduced as above, please point out to the P.D.A. to avoid heavy recovery at a later stage.
Loss of Documents:-
1. In case P.P.O. is lost in transit before receiving first payment, PDA should be approached to furnish loss certificate to the Pension Sanctioning Authorities for issue of duplicate copy of the P.P.O.
2. In case pension certificate is lost before receiving first payment, Pension Sanctioning Authority may be approached through respective Record Office/Head of the office for issue of duplicate Pension Certificate.
3. In case pension certificate is lost, exhausted, mutilated after receiving first payment, P.D.A. should be approached to issue duplicate/additional copy of Pension Certificate.
Receipt of Pension Papers:-
1. Pension sanctioning authorities send the PPOs to the respective Record Offices in respect of PBORs, Heads of the office in respect of Defence Civilians and to the Pension Disbursing Authorities in respect of Commissioned officers.
2. Record offices send the PPOs along with the Descriptive Rolls to the desired P.D.A. with a copy to the pensioners along with Pension Certificates. Similarly Heads of the offices send the PPOs and the Pension certificates to the PDAs with a copy to the Pensioners. PPOs along with descriptive particulars in respect of commissioned officers are sent directly to the PDAs under intimation to the officers.
3. On receipt of Call letter from the PDAs or within reasonable time, the pensioners should report to the PDA for receiving first payment. The pensioners are required to produce pension certificate/intimation letter received from the Head of office/RO/PSA as the case may be to the P.D.A.
Missing Pensioner:-
1. In case a pensioner is missing, his family should lodge an F.I.R. with the police authorities. If the pensioner is not traced after one year she should obtain a certificate from the police authorities and report the matter to the PDA and submit the required documents i.e. Indemnity Bond to him to enable him to submit the case to this office for sanction of family pension from the date of lodging F.I.R.

1. If you want to represent any problem to the office of PCDA (P) please furnish following information/particulars along with full details of your problem/grievance.

Arrear of Pension:-
1. Pension undrawn for more than one year becomes time barred, which is paid only after sanction of the Competent Authority i.e. TO/PAO/DPDO. In the case of PSBs, the arrear claim on the prescribed form should be submitted to the bank to enable them to obtain the sanction of PCDA (P) Allahabad/CDA Chennai/CDA (PD) Meerut.
Joint Notification of Family Pension:-
1. The widow in whose favour the pension has been jointly notified should report the death of her husband to the P.D.A. and submit the death certificate to enable him to commence payment of family pension from the date following the date of death of her husband.
Nomination for LTA:-
1. Pensioners are advised to nominate their families in whose favour family pension has been jointly notified to enable her to receive lifetime arrears in case of his death. In case his wife is not alive he should nominate other members of his family to avoid inconvenience in obtaining Life Time Arrears by the Legal heirs.
Certificates:-
Submit periodical certificates regarding re-employment/ employment/ earning widowhood to your P.D.A. on due dates in order to regulate your pension correctly.
Physically Handicapped Mentally Retarded Children:-
1. If you have any physically handicapped/mentally retarded child, you may apply to your HOO/RO/Army Hqrs. for making an endorsement in your service & pension record and keep the acknowledgement of this intimation.
RSMB:-
1. You are advised to appear before the Re-Survey Board on due date as arranged by the Record-office. In case you fail to appear before R.S.M.B. for a long time, submit delay explanation alongwith non conviction and non-reemployment certificates to the R.O. for arranging a fresh R.S.M.B.
Rejection of Dis. Pension:-
In case disability pension is rejected, you may make an appeal to the Govt. of India within 6 months through Record Office, if you feel that the disability in your case is due to service factors. Similarly family of the deceased can also make an appeal, if the claim for special family pension is rejected.
Family Members:-
1. If a pensioner has married after discharge or has children born after discharge, or wife/children have died report the matter with full details and certificates (birth/death/marriage/remarriage) to Record Office/Head of the Office for record in Kindred Roll portion of Sheet-roll/Service Book in order to avoid any difficulty in the event of need.
2. If joint notification of family pension has not been done in your case, apply to your P.D.A. on the proper form to enable him to process the joint notification of F.P. through R.O./H.O.O., A.H.Qrs.
Two Pensions:-
If a pensioner is in receipt of more than one pension, he should furnish full details to the P.D.A. for revision of both the pensions and regulating dearness relief on both the pensions
Restoration of Commuted Portion of Pension:-
1. Commuted portion of pension will be restored by the P.D.A. on his own without obtaining any order from this office after obtaining requisite application after 15 years from the date of first payment or from the date pension was reduced in case of subsequent commutation. Convicted Pensioner:-
If a pensioner is convicted or sentenced to imprisonment by a Court, his pension will be suspended. He should submit the copy of the Court order to the PDA to enable him to report the matter to this office for obtaining the orders of the Competent Authority. On release from the Jail he should report the matter to the P.D.A. and submit the requisite documents to enable him to refer the matter to this office for obtaining the orders of the C.E.A. for restoration of his pension.
Annual Identification:-
1. A life certificate is required to be produced by the pensioner, who is unable to appear due to bodily illness or infirmity and desires payment through a representative once in the month of November each year.
2. Pensioners who are receiving payment from PSBs and D.P.D.Os should appear before the P.D.A. once each year in the month of November for identification
Court Attachment:-
1. No pension whether due or to become due can be attached by process of any Court until it has actually been paid as per pension Act XXII of 1871.
2. No pensioner can assign or sell any interest in respect of the pension not then due.
Insane Pensioner:-
1. If a pensioner becomes insane, his dependents should obtain a certificate from the Magistrate and produce the pension certificate and life certificate for drawing pension. If the pensioner is lodged in an asylum the cost of pensioner's maintenance will be paid by the dependents to the asylum authorities as per orders of the Court on an application by the asylum authorities under the provisions of section 25 of Lunacy Act.
Payment of Dearness Relief:-
Group 'A' officers are not entitled to dearness relief during re-employ under a Govt. office/company/Corporation/Undertaking/Autonomous body. PBORs are entitled for dearness relief during re-employment under above organizations subject to production of a certificate from his re-employer that his pay has been fixed at the minimum of the scale of the post on which he has been re-employed and his entire amount of pension has been ignored in fixation of pay on re-employment. Drawal of Pension Through Agent:-
Pensioners who desire to draw pension while residing outside India may open a non-resident account in any of the Scheduled Public Sector Banks in India. He should execute a power of attorney in India before proceeding Ex.India on a non-judicial stamp paper or on a plain paper affixed with adhesive stamp paper of appropriate value, before the Notary Public or any Magistrate. The pensioner shall furnish life certificate once a year through High Commission/Embassy of that Country where he/she resides. If he has changed his nationality in Country other than South Africa and Israel. Sanction of this office will be required through his P.D.A. for continuation of his pension.
Release of Withheld Gratuity:-
1. The withheld amount of D.C.R.G. is payable after six months from the date of retirement without any authorisation from this office.
2. If a pensioner desires to get his pension account transferred from one P.D.A. to another in India, he is required to submit an application to his present P.D.A. No application is required to be submitted to this office. Transfer of pension accounts outside India is not permissible.
Commutation of Pension:-
Commuted portion of pension is required to be reduced from pension from the date of payment or after 3 months from the date of issue of P.P.O. and in the case of P.S.Bs from the date, capitalised sum is credited to the pensioners' account. If the commuted portion of pension is not reduced as above, please point out to the P.D.A. to avoid heavy recovery at a later stage.
Loss of Documents:-
1. In case P.P.O. is lost in transit before receiving first payment, PDA should be approached to furnish loss certificate to the Pension Sanctioning Authorities for issue of duplicate copy of the P.P.O.
2. In case pension certificate is lost before receiving first payment, Pension Sanctioning Authority may be approached through respective Record Office/Head of the office for issue of duplicate Pension Certificate.
3. In case pension certificate is lost, exhausted, mutilated after receiving first payment, P.D.A. should be approached to issue duplicate/additional copy of Pension Certificate.

PATIALA: Indian Ex-Services League, Punjab & Chandigarh has sought a better deal for Havildars and Sub Majors from the Centre Govt. Prabhjot Singh Chhatwal, president of league in his memorandum faxed to Defence Minister, A.K. Antony, has asked the govt. to change the Pay-Band for Havildars and equivalent ranks from PB-I to PB-II and for Sub. Majors and equivalent ranks from PB-II to PB-III since the Sixth Pay Commission have not done justice with these ranks.
League stressed upon the govt. that the soldiers of the rank of Havildar form the real back-bone of Defence Forces and Sub. Major acts as a Chief executor of the strategy in the war. These two ranks have been virtually crushed by the partial recommendations of Sixth Central Pay Commission and further faulty implementation of the recommendations regarding their pay scales. The Havildars have been virtually equated to class-IV civilian such as Peons, Chowkidars, Mali and Dhobi etc. in respect of pay.
League has further asked the Minister to release immediately the orders for promised ONE RANK ONE PENSION for Junior Commissioned Officers, Senior Non-Commissioned Officers, Non-Commissioned Officers and other ranks which was announced by Finance Minister in Union Budget on 6 July 2009, and then by the Minister him self in the Parliament and finally by Prime Minister on Independence Day but the order regarding the same has not not been issued so far.
League has also reminded the Minister that the govt. has also promised to give pension to soldiers up to the rank of Hav. @ 70% and to JCOs @ 60% of the last pay drawn to compensate for their early compulsory retirement, but to the great disappointment of the soldiers, these orders have also not seen the light so far whereas orders regarding change of Pay Band from PB-III to PB-IV for the Lt. Col. have been issued long ago although these recommendations were made by the same group of ministers in the same report. With this partial treatment given to lower ranks, a great resentment is prevailing in the Defence Forces and among the veterans which is not good for nations security.
League has further demanded two pensions for the widows of ex-servicemen who drew two pensions during their life time. Because of early compulsory retirement, most of the soldiers have to seek employment in civil deptts. to compensate their meager pension which they draw by virtue of their service in the Defence Forces. Such veterans draw two pensions after their retirement from civil deptts. but their widows are not entitled for second pension as per the present pension policy of the govt.
Along with this, League has gone further to demand befitting alternate re-employment for the soldiers up to the age of 60 years like their civilian counter parts since about 90% among the soldiers are compulsory retired prior to their superannuation to keep the forces young.
League has vehemently stressed upon the govt. to fulfill the demands of veterans at the earliest lest they may come on the roads like civilian counter parts and the govt. will be in a critical position to handle that volcanic situation.
Last but not the least, the league has forcefully demanded of the govt. not to use the term PBORs for Junior Commissioned Officers, Senior Non-Commissioned Officers, Non-Commissioned Officers and other ranks as they feel much humiliated by being referred as such.

If our security can be threatened by retired army men, then that shows how weak our setup is, and this should be corrected. GOVT ORDERS ON PENALITY FOR DELAYED PAYMENTS : PENSION PAYMENT PROCEDURES

In para 61 of the 44th Report of Parliamentary
Standing Committee on MHA, the Committee had observed
that timely payment of pension and retirement dues
is not being made to the retiring employees of
Union Govt. TheCommittee drew attention to the
Employees Provident Fund Scheme and the Notification
issued by the Ministry of Labour on 27.10.97
amending the Employees Pension Scheme, 1995. In
terms of provisions under Employees Provident Fund
and Misc. Provisions Act. 1952, the Ministry of
Labour inserted a new provision 17A Payment of
Pension which interalia says that "in case the
Commissioner fails without sufficient cause to
settle a claim complete in all respects within
30 days, the Commissioner shall be liable for the
delay beyond the said period and penal interest
at the rate of 12% per annum may be charged on the
benefit amount and the same may be deducted from
the salary of the Commissioner," On the same
analogy the Committee has recommended that
similar provisions may be formulated and enforced
to ensure timely payment of pension and retirement
dues to the retiring employees of Union Government.
2. As per CCS(Pension) Rules 1972, no interest
is payable on delayed payment of pensions,
commuted value of pension. However, the above
recommendation of the Committee on delayed
payment of retirement dues has been exarned in
this Department in consultation with Department
of Personnel and Training, Department of
Expenditure, Ministry of Fin., and it has been
decided to implement the recommendation as
detailed below:-
(a) All pensioners' dues are to be settled by
strictly following the procedure laid down in
Rules 56 to76of CCS (Pension)Rules, 1972.
(b) Wherever delays are anticipated,provisional
pension should be sanctioned inlmediately.
(c)Any delay in processing of pension resulting
in pension not being authorized on the last
working day of retirement of the government
servant, should be brought out by the Head of
Office to the next higher authority who would
watch the settlement of delayed cases.
(d) In respect of delayed payment of gratuity
wherever itresults in payment of penal interest
at the rate applicableto GPF deposits (at
present 12% p.a. compounded annually) under
Rule 68 of CCS(Pension)Rules 1972.Secretary of
the Administrative Ministry or Department would
initiate action to fix responsibility, at all
levels to recover the amount from the concerned
dealing Official,Supervisor and Head of Office
in proportionate to their salary by following
the prescribed procedures for the purpose. This
should be strictly enforced with immediate effect.
(e) Once it has been decided to pay gratuity
the amount should be paid immediatetly, pending
a decision regarding payment of interest. This
would reduce the interest liability if any on
payment of delayed gratuity.
(f)In the matter of delayed payment of leave
enncashment, the Department of Personnel and
Training in their note dated 2.8.99 has
clarified that there is no provision under
CCS (Leave)Rules for payment of interest or
for fixing responsibility. Moreover encasnment
of leave is a benefit granted under the leave
rules and not a pensionary benefit.
(g) In the matter of CGEGIS,the Department of
Expenditure, Ministryof Finance in their V.D.
No. 709/EV/99 dated 6.8.99 has clarified that
payments under CGEGIS cannot be termed as
terminal benefits. As payments under this
Scheme are made in accordance with the Table
of Benefit which takes into account interest
upto the date of cessation of service, no
interest is payable on account of delayed
payments under the scheme. They have also
clarified that CGEGIS payment cannotbe with
held(and no Government dues can be recovered
from the accumulation except the amount
claimed by the financial institution as due
from the employee on account of loans taken
for house building purpose.)
3. Contents of this OM may also be brought
to the notice of concerned attached/
subordinate/field organisations under the
administrative control of respective
Ministry/Department, for compliance.
4. In so far as persons serving in the
Indian Audit and Accounts Department are
concerned, these orders issued after

Subject : Grant of Dearness Relief to Central Government pensioners/family pensioners – Revised rate effective from 1.7.2009.
The undersigned is directed to refer to this Department’s OM No. 42/12/2009-P&PW(G) dated 27th March, 2009 on the subject mentioned above and to state that the President is pleased to decide that the Dearness Relief payable to Central Government pensioners shall be enhanced from the existing rate of 22% to 27% w.e.f. 1st July, 2009.
2. These orders apply to (i) All Civilian Central Government Pensioners/Family Pensioners (ii) The Armed Forces Pensioners, Civilian Pensioners paid out of the Defence Service Estimates, (iii) All India Service Pensioners (iv) Railway Pensioners and (v) The Burma Civilian pensioners/family pensioners and pensioners/families of displaced Government pensioners from Pakistan, who are Indian Nationals but receiving pension on behalf of Government of Pakistan, who are in receipt of ad-hoc ex-gratia allowance of Rs. 3500/- p.m. in terms of this Department’s OM No. 23/1/97-P&PW(B) dated 23.2.1998 read with this Department’s OM No. 23/3/2008-P&PW(B) dated 15.9.2008.
3. Central Government Employees who had drawn lumpsum amount on absorption in a PSU/Autonomous body and have become eligible to restoration of 1/3rd commuted portion of pension as well as revision of the restored amount in terms of this Department's OM No. 4/59/97-P&PW (D) dated 14.07.1998 will also be entitled to the payment of DR @ 27% w.e.f. 1.7.2009 on full pension i.e. the revised pension which the absorbed employee would have received on the date of restoration had he not drawn lumpsum payment on absorption and Dearness Pension subject to fulfilment of the conditions laid down in para 5 of the O.M. dated 14.07.98. In this connection, instructions contained in this Department’s OM No.4/29/99-P&PW (D) dated 12.7.2000 refers.
4. Payment of DR involving a fraction of a rupee shall be rounded off to the next higher rupee.
5. Other provisions governing grant of DR in respect of employed family pensioners and re-employed Central Government Pensioners will be regulated in accordance with the provisions contained in this Department's OM No. 45/73/97-P&PW (G) dated 2.7.1999 as amended vide this Department’s OM No. F. No. 38/88/2008-P&PW(G) dated 9th July, 2009. The provisions relating to regulation of DR where pensioner is in receipt of more than one pension will remain unchanged. Contd..2..

6. In the case of retired Judges of the Supreme Court and High Courts, necessary orders will be issued by the Department of Justice separately.
7. It will be the responsibility of the pension disbursing authorities, including the nationalized banks, etc. to calculate the quantum of DR payable in each individual case.
8. The offices of Accountant General and Authorised Public Sector Banks are requested to arrange payment of relief to pensioners etc. on the basis of above instructions without waiting for any further instructions from the Comptroller and Auditor General of India and the Reserve Bank of India in view of letter No. 528-TA, II/34-80-II dated 23/04/1981 of the Comptroller and Auditor General of India addressed to all Accountant Generals and Reserve Bank of India Circular No. GANB No. 2958/GA-64 (ii) (CGL)/81 dated the 21st May, 1981 addressed to State Bank of India and its subsidiaries and all Nationalised Banks.
9. In their application to the pensioners/family pensioners belonging to Indian Audit and Accounts Department, these orders issue in consultation with the C&AG.

PATIALA. 27 September – Indian Ex-Services League, Punjab & Chandigarh, the oldest and a non-political body of ex-servicemen, has sought a better deal for Havildars and Sub. Majors from the Centre Govt.
In its detailed memorandum faxed to Defence Minister, Sh. A.K. Antony, the league had asked the govt. to change the Pay-Band for Havildars and equivalent ranks from PB-I to PB-II and for Sub. Majors and equivalent ranks from PB-II to PB-III since the Sixth Pay Commission has not done justice with these ranks. League stressed upon the govt. that the soldiers of the rank of Havildar form the real back-bone of Defence Forces and Sub. Major acts as a Chief executor of the strategy in the war. These two ranks have been virtually crushed by the partial recommendations of Sixth Central Pay Commission and further faulty implementation of the recommendations regarding their pay scales. The Havildars have been virtually equated to class-IV civilian such as Peons, Chowkidars, Mali and Dhobi etc. in respect of pay.
League has further asked the Minister to release immediately the orders for promised ONE RANK ONE PENSION for Junior Commissioned Officers, Senior Non-Commissioned Officers, Non-Commissioned Officers and other ranks which was announced by Finance Minister in Union Budget on 6 July 2009, and then by the Minister him self in the Parliament and finally by Prime Minister on Independence Day but the order regarding the same has not been issued so far.
League has further reminded the Minister that the govt. has also promised to give pension to soldiers up to the rank of Hav. @ 70% and to JCOs @ 60% of the last pay drawn to compensate for their early compulsory retirement, but to the great disappointment of the soldiers, these orders have also not seen the light so far whereas orders regarding change of Pay Band from PB-III to PB-IV for the Lt. Col. have been issued long ago although these recommendations were made by the same group of ministers in the same report. With this partial treatment given to lower ranks, a great resentment is prevailing in the Defence Forces and among the veterans which is not good for nations security.
League has further demanded two pensions for the widows of ex-servicemen who drew two pensions during their life time. Because of early compulsory retirement, most of the soldiers have to seek employment in civil deptts. to compensate their meager pension which they draw by virtue of their service in the Defence Forces. Such veterans draw two pensions after their retirement from civil deptts. but their widows are not entitled for second pension as per the present pension policy of the govt.
Along with this, League has gone further to demand befitting alternate re-employment for the soldiers up to the age of 60 years like their civilian counter parts since about 90% among the soldiers are compulsory retired prior to their superannuation to keep the forces young.
League has vehemently stressed upon the govt. to fulfill the demands of veterans at the earliest lest they may come on the roads like civilian counter parts and the govt. will be in a critical position to handle that volcanic situation.

Sub:- Post- Sixth CPC Demands of Veterans.
Most Respected Sir,
On behalf of the veterans from all over the Punjab and those who are approaching us from other states of India i.e. Rajasthan, Gujarat, Maharashtra, Orrisa, Tamilnad and Madhya Pradesh etc. I append the following few points for your kind perusal and an immediate favourable action:-
1. Immediate release of orders for One Rank One Pension for the veterans below the Commissioned Ranks. The veterans all over India were much elated when the Finance Minister announced One Rank One Pension for the Veterans below the Commissioned Rank during the Budget speech on 6th July, 2009. Subsequently, your were also pleased to announce the same for all Defence Personnel to quell the storm raised by Senior Veterans (Commissioned Ranks) of Defence Forces. Finally Hon'ble Prime Minister also put his stamp of approval in his much publicized speech on Independence Day at New Delhi.
But to the utter disenchantment of veterans, mostly on the verge of death, your esteemed govt.
has, so far, not released the orders for the same perhaps to test the patience of the veterans. The same may please the released at the earliest.
2. Grant of pension @ 70% to veteran below the rank of Hav. and @ 60% to JCOs. It will be not out of place to remind you, sir, that your deptt. was pleased to accept the recommendation of GoM. to grant pension @ 70% of the last pay drawn to soldiers up to the rank of Havildars and @ 60% to JCOs to compensate them for their compulsory retirement before the superannuation. The GoM. recommended this along with their approval for granting change of Pay-Band from PB-III to PB-IV for Lt. Cols.
It is in fact a matter of great pittance that Lt. Cols. have been granted their benefit long ago, govt. doling out lakhs of rupees to them as arrears where as "poor veterans below the commissioned ranks", who count for 96% among the whole lot of veterans, have, so far, been kept waiting for the loaf to be dropped in their mouth by your deptt. The same may please be granted at the earliest.
3. Change of Pay Band from PB-I to PB-II for Hav. / SGT / Petty Officer and from PB-II to PB-III for Sub. Maj. / M.W.O. / M.C.P.O. Your deptt. vide its Gazette notification (Part –II Sec.) F.No. 11(5) 200B/D(CN-I) dt. 28-08-2009, has displayed a great magnanimity by revising the Pay Band of Master Craftsman of Work Shop Staff (Old scale 4500-7000, New scale 5000-8000) on par with Railway Employees) from PB-I to PB-2 with Grade Pay Rs. 4200/-.
But the Hav. / Sgt. / Petty officer of the Defence Forces, who are highly skilled personnel and up keep the maintenance of tanks, Air Crafts and War Ships, drawing a better pay in old scale (Rs. 7230/-, Rs. 7920/- and Rs. 8700/-) have been kept in PB-I with grade pay Rs. 2800/-. These personnel deserve to be placed in Pay Band-II with grade pay of Rs. 4800/-
Similarly Sub. Major drew more pay, in old scale (Rs.. 8600/-) than a newly commissioned Lt. (Rs. 8250/-) who has been placed in PB-III but Sub. Maj. remains in PB-II.
Thus, Sub. Major (and equivalent ranks in Air Force and Navy), the senior most Junior Commissioned Officer, who is the Chief executor of strategy in war time and strongest link between the commissioned officers and the personnel below the commissioned ranks, highly deserves to be placed in PB-III as a matter of Honour and long service to the nation.
4. Grant of two Pensions to the widow of a veteran who
drew two pensions during his life time. Because of compulsory retirement before superannuation, the veteran has to take a second service in civil deptts. after his retirement. If he completes ten years in the new employment he gets the second pension. But the widow is not entitled for second family pensions as per the present pension policy in vogue in India. This is a sheer injustice with the widow and her children. Govt. should not debar the widow to draw second family pension since it was due to the fact that her husband was not allowed to serve in Defence Forces, only, to keep the forces young and active and he had to take up second service in civil. Had the solider been allowed to serve up to the age of superannuation, he would got more pension as per rank and subsequently the widow could get more family pension.
As such, these widows deserve to retain two pension. You are
requested to look in to it favorably.
5. Provision of befitting alternate re-employment for the soldiers up to the age of 60 years like their civilian counter parts. Since about 90% among the soldiers are compulsory retired prior to their superannuation to keep the forces young, the provision of a befitting alternate re-employment for the soldier up to the age of 60 becomes the necessity and the liability of the govt. As such, this may be looked in to favorably and the provision be made for this.
6. Discarding of term PBORs being used for addressing JCOs, SNCOs, NCOs and other ranks. Last but not the least, the league demands the govt. not to use the term PBORs for Junior Commissioned Officer, Senior Non-Commissioned Officer, Non-Commissioned Officers and other ranks as the soldiers and the veterans feel much humiliated by being addressed as such.

PATIALA. 27 September – Indian Ex-Services League, Punjab & Chandigarh, the oldest and a non-political body of ex-servicemen, has sought a better deal for Havildars and Sub. Majors from the Centre Govt.
In its detailed memorandum faxed to Defence Minister, Sh. A.K. Antony, the league had asked the govt. to change the Pay-Band for Havildars and equivalent ranks from PB-I to PB-II and for Sub. Majors and equivalent ranks from PB-II to PB-III since the Sixth Pay Commission has not done justice with these ranks. League stressed upon the govt. that the soldiers of the rank of Havildar form the real back-bone of Defence Forces and Sub. Major acts as a Chief executor of the strategy in the war. These two ranks have been virtually crushed by the partial recommendations of Sixth Central Pay Commission and further faulty implementation of the recommendations regarding their pay scales. The Havildars have been virtually equated to class-IV civilian such as Peons, Chowkidars, Mali and Dhobi etc. in respect of pay.
League has further asked the Minister to release immediately the orders for promised ONE RANK ONE PENSION for Junior Commissioned Officers, Senior Non-Commissioned Officers, Non-Commissioned Officers and other ranks which was announced by Finance Minister in Union Budget on 6 July 2009, and then by the Minister him self in the Parliament and finally by Prime Minister on Independence Day but the order regarding the same has not been issued so far.
League has further reminded the Minister that the govt. has also promised to give pension to soldiers up to the rank of Hav. @ 70% and to JCOs @ 60% of the last pay drawn to compensate for their early compulsory retirement, but to the great disappointment of the soldiers, these orders have also not seen the light so far whereas orders regarding change of Pay Band from PB-III to PB-IV for the Lt. Col. have been issued long ago although these recommendations were made by the same group of ministers in the same report. With this partial treatment given to lower ranks, a great resentment is prevailing in the Defence Forces and among the veterans which is not good for nations security.
League has further demanded two pensions for the widows of ex-servicemen who drew two pensions during their life time. Because of early compulsory retirement, most of the soldiers have to seek employment in civil deptts. to compensate their meager pension which they draw by virtue of their service in the Defence Forces. Such veterans draw two pensions after their retirement from civil deptts. but their widows are not entitled for second pension as per the present pension policy of the govt.
Along with this, League has gone further to demand befitting alternate re-employment for the soldiers up to the age of 60 years like their civilian counter parts since about 90% among the soldiers are compulsory retired prior to their superannuation to keep the forces young.
League has vehemently stressed upon the govt. to fulfill the demands of veterans at the earliest lest they may come on the roads like civilian counter parts and the govt. will be in a critical position to handle that volcanic situation.

Here is What Maj.Gen. R.N.Radhakrishnan (Retd.) would like to share with the veterans after meeting the RRM.
Dear Veterans
I had an opportunity to meet the RRM on 16th at 1500 H; thanks to Brig RKS Gulia, the President IESL. Brig Gulia apprised the Minister of the IESL and the various problems that haunt the ESM community.
One point, he made that I would take the liberty to convey to you all, is for initiating periodic meetings with ESM community not only at the Center level but also at the State levels. IESL also presented a brief on the Cabinet Secretary’s (CS for short) Report of 30th June 2009.
In my turn, as I was given the opportunity to talk about our demand on pension, I focused on the two misperceptions on the part of the CS.
· First; his concentrated effort to drive home the fact that OROP was not approved by the Courts and the Ministers in the past, was based purely on the wrong perception of the interpretation of OROP. He had relied on the Ministry of Law and Justice’s comment describing OROP as one rank one pension with no regard to the difference in the service rendered thereby the difference in the average emoluments that count for the pension. I categorically pointed out to the RRM that presenting that argument is purely to divert the attention on the correct definition of our demand for pension as ‘same pension for same rank with same years of qualifying service’.
· Second; The CS has repeatedly equated the Armed Forces personnel with Civilian Government employees, in his report. I had highlighted to the RRM the various points to prove that there can never be any comparison leave alone equation. For details you may read my earlier mail on the ‘Analysis of CS’s Report’.

I had an opportunity to meet the RRM on 16th at 1500 H; thanks to Brig RKS Gulia, the President IESL. Brig Gulia apprised the Minister of the IESL and the various problems that haunt the ESM community.
One point, he made that I would take the liberty to convey to you all, is for initiating periodic meetings with ESM community not only at the Center level but also at the State levels. IESL also presented a brief on the Cabinet Secretary’s (CS for short) Report of 30th June 2009.
In my turn, as I was given the opportunity to talk about our demand on pension, I focused on the two misperceptions on the part of the CS.

Portraying himself to be too busy to answer the high court’s summons in a case pertaining to the release of pensionary benefits of a 75-year-old war veteran has landed a senior bureaucrat in a spot.
Rejecting the exemption plea of the Controller of Defence Accounts (CDA), Meerut, the Punjab And Haryana High Court has issued warrants against him and directed SSP, Meerut, to ensure the officer’s presence on the next date of hearing.
Pronouncing the orders in an open court today, the Bench also ruled that the SSP should appear before the court at the next date of hearing in case he fails to comply the HC’s orders.
The 75-year old veteran, HS Lamba, has been waging a legal battle to get his reservist pension sanctioned. In separate cases disposed-off earlier, the HC had ruled that depending upon their service profile, some reservists were entitled to pension.
The CDA, in his exemption application put up before the court had contended that he was busy with the visit of the Controller General of Defence Accounts to Meerut on September 15. He had also claimed that he was holding the charge of two establishments and hence be exempted because of the heavy workload. The court, however, did not accept the grounds on which the exemptions were sought. The CDA had also missed out on attending earlier hearings also.
In a separate case concerning contempt of court, the high court today ordered the present defence secretary to appear before it on October 9. The petitioner, Lt Col Surjit Singh, had been granted pension by the HC after a long legal battle, but the orders had not been implemented by the authorities

5 YEARS OF ESM WELFARE ; DEPT OF ESM MOD GOVT OF INDIA

The Department of Ex-Servicemen Welfare (ESW), functioning under the Ministry of Defence, completes five years of its existence next week. Set up on September 22, 2004, the department caters exclusively to the rehabilitation and welfare of about 21lakh Ex-Servicemen (ESM) population and another five lakh ESM widows. Nearly 60,000 ESM are added to this huge number every year, largely due to perhaps the highest attrition rate in any organized sector among the Armed Forces in order to retain a youthful profile of the fighting forces, their primary task. Taken together with ESM dependents ranging between 50-70 lakhs, the Department of ESW shoulders responsibility of the welfare of roughly one crore population of ESM and their dependents.
The Department of ESW achieves its objectives through its three attached offices, consisting of the Directorate General of Resettlement (DGR), the Kendriya Sainik Board (KSB) and the Ex-Servicemen’s Contributory Health Scheme (ECHS), besides coordinating with the Principal Controller of Defence Accounts (PCDA), Allahabad. In January 2008 the Department of ESW came to be headed by a full-fledged Secretary-level officer, underlining the government’s commitment to the concerns of the huge ESM population. Besides helping the veterans resettle in a suitable second career, the department provides healthcare and ensures timely payment of benefits and pension to the ESM and their dependents.
The Directorate General of Resettlement (DGR) is the first avenue for the Services personnel on the verge of superannuation. It imparted training to over 34,000 officers and Persons Below Officer Rank (PBORs) during 2008-09 besides granting jobs to 51,000 ESM and securing placement for another 30,000 ESM in DGR-sponsored security agencies last year. The DGR, being the nodal agency for resettlement of ESM, has in recent years tied up with reputed management institutes to offer post-graduate diplomas to Services officers. It runs several successful ESM reemployment programmes including the popular Mother Dairy Milk and Fruit and Vegetable booths, placement in empanelled private security agencies, coal tipper scheme, allotment of army surplus vehicles, management of CNG stations and toll plazas under the NHAI and sponsoring ESM for the allotment of 8 percent quota of LPG, petrol pump and kerosene outlets reserved for wartime/peacetime widows and disabled soldiers. Last year 287 Mother Dairy outlets were allotted to ESM/dependents sponsored by the DGR. The DGR’s stupendous success in the placement of ESM in security agencies can be gauged from the fact that the number of ESM employed jumped from over 27,000 in 2007 to over 40,000 in 2008 while another over 17,000 have been successfully granted placement this year till May, 2009.
The Kendriya Sainik Board (KSB), the apex body for the welfare of war-wounded and other Ex-Servicemen (ESM), keeps in constant touch with the large ESM community, fulfilling their needs and aspirations through the 32 Rajya Sainik Boards and 355 Zila Sainik Boards spread across the country. KSB doles out about Rupees 7 crores aid every year to ESM, widows, children and orphans through welfare schemes out of the Armed Forces Flag Day Fund, which includes the Raksha Mantri’s Discretionary Fund ranging between Rs.5,000-1,25,000. The government recently amended the eligibility to include ESM up to the rank of Havildar and equivalent in the Navy and Air Force under the scheme. In another major initiative the KSB has in recent years replaced the crude motorized tricycles with the new modified 4-wheeled Honda Activa scooters distributed free of cost to the disabled ESM. The KSB also provides funds to the Red Cross Society, Cheshire Homes and Military Hospitals for the treatment and care of ESM and their wards and administers the award of more than 3,500 Prime Minister’s scholarships every year to wards of ESM.
The Ex-Servicemen’s Contributory Health Scheme (ECHS) is another big success story in the Department of ESW’s endeavours and concerns for the ESM welfare. Founded in April 2003, the ECHS today has a vast network of 2,267 polyclinics, its membership jumping nearly ten-fold, - from 3.5 lakhs in 2005 to over 30 lakhs. ESM with disabilities who had to travel long distances to the Artificial Limb Centre, Pune, are now getting such medical aid from about 150 Central Government Health Scheme (CGHS) -empanelled centres across the country. The government has also hiked ECHS allocation from Rs. 82.85 crore in 2004-05 to Rs. 690 crores in the current financial year. The Department of ESW further proposes to include soon the Nepal-domiciled Gorkhas, who continue to receive medical aid from the Armed Forces Flag Day Fund, under the ECHS and has given ‘in principle’ approval for setting up a Pension Payments Office (PPO) in Butwal, Nepal.
But all efforts and welfare schemes would come to a naught if the ESM does not get his monthly dues on time. The Principal Controller of Defence Accounts (PCDA), Allahabad is the nodal office, handling pension for about a whopping 17 lakh ESM and dependents through banks, treasuries, Pension Disbursing Offices besides the vast postal network all over the country. The government has recently issued instructions to issue simultaneous notification of Service and Disability Pension to avoid delays in release of the latter. Unmarried daughters over 25 years of age and widowed / divorced daughters dependent on the ESM have now been granted family pension and several other steps to support the ESM dependents have been introduced. Other major initiatives include, - hiking minimum pension from Rs. 1,913 to Rs.3,500 pm, removal of linkage of full pension with a qualifying service of 33 years from Jan.01, 2006, commutation of pension increased, gratuity hiked from Rs.3.5 lakhs to Rs.10 lakhs and special family pension hiked from Rs.2,550 to Rs.7,000 pm. The government has also improved pension for Ex-service personnel, besides benefits accruing out of the Sixth Pay Commission including Military Service Pay to Armed Forces personnel and awarding a higher separate Pay Bands for officers of the rank of Lt. General and Lt. Colonel, or equivalent, respectively. Additional pension has been granted in varying range for elderly pensioners, with the government granting cumulative benefits of Rs.2,144 crores to the men in the three Services and the ESM.
Pension Adalats have been a tremendous success in settling disputes related to ESM spread across the country; six such Adalats are normally held in places with large concentration of ESM population.
In contribution of the sacrifices made by the martyrs, war-wounded, Ex-Servicemen and their dependents, the DGR marks December 7 every year as the Armed Forces Flag Day (AFFD) when the nation remembers its veterans and generously contributes to the Flag Day Fund.

SUGGESTION FOR SUBSTANTIAL IMPROVEMENT/PARITY IN PENSIONS OF PRE-1.1.06 PBOR RETIREES W.E.F.1/7/09( AS ENVISAGED IN UNION BUDGET ON 06.7.09 )
Honourable Defence Minister Sir,
1. My heartfelt Gratitude/Salutations for your humane consideration, the Pensions issue of PBORs ( pathetic plight) resulting in time bound finalization of the CoS Committee (headed by the Cabinet Secretary) recommendations for PIP/OROP in r/o pre-&;post 1.1.96, pre and post 10.10.97, and pre 1.1.06 PBORs on par with pensions of post 1.1.06 retirees, its acceptance by the Govt of India, which became History. And Sir, the HONOURABLE FINANCE MINISTER, in his Budget Speech on 6.7.09, announced that the Govt. had decided to (1) TO SUBSTANTIALLY IMPROVE PENSIONS OF PRE-1.1.96 PBOR RETIREES (2) BRING PRE-& POST-10.10.97 PBORS RETIREES ON PAR WITH POST- 1.1.06 PBOR RETIREES (3) GIVE EFFECT FROM 01.07.09.
BRIEF HOSTORY – PBORs PENSIONS:-
In this context, I wish to bring to your kind notice, that the MINIMUM/ MAXIMUM PENSIONS were fixed during different CPCs (IV, V and VI) based usually on a criteria of qualifying service to earn pension(minimum 15 years), Rank held at the time of release, last 10 months average emoluments drawn. The Minimum/Maximum Pensions of Defence pensioners were fixed @Rs.375/-/(LOWEST) and Rs.4500/-pm (HIGHEST)(OF CIVILIAN PENSIONERS)w.e.f.1.1.86 (IV CPC), and were revised to Rs.1275/-(by 3.4 times) and Rs.15000/-(by 3.333 times)(LOWEST/ HIGHEST SLABS) w.e.f.1.1.96 (V CPC), as per GOI OM No. F.No.45/86/ 97-P&PW(A)Part II D/d 27.10.1997. These CIVIL PENSIONERS provisions were, IPSO FACTO, applied to PBORs pensioners without taking into a/c the entirely different trade/group structure, pay scales/responsibilities attached to the duties of Armed Forces Personnel.
The GOI, MOD vide No.(1)/99/D(Pen/ Sers), D/d 7.6.99, had modified the provisions relating to Minimum/Maximum Pensions, viz:- ‘PARA 1…w.e.f. 1.1.96, pension of all Armed Forces Pensioners irrespective of their date of retirement SHALL NOT BE LESS THAN 50% OF THE MINIMUM PAY IN THE REVISED SCALES OF PAY INTRODUCED W.E.F. 1.1.96 OF THE RANK AND RANK AND GROUP (IN CASE OF PBORS) HELD BY THE PENSIONERS” and “PARA 2.2.(a). The revision of service pension in terms of these modified Orders in respect of PBOR retirees will not be beneficial except for the rank of JCOs granted Hony.commission of Lt/Capt as the service pension is calculated at the maximum of the pay scale including 50% of the highst classn allowance, if any, of the rank/group in which it is paid.” These orders were implemented without applying the criteria “ NOT LESS THAN 50% MIN.”scale of pay of Rank/Group held on retirement by PBORs.
In the meanwhile Sir, the MOD had Restructured all the Groups/Trades of Armed Forces personnel, based on ENTRY QUALIFICATION criteria (Spl AFI 1/S/98) such as Matric/Non-Matric/Diploma/Degreee qualifications, w.e.f. 10.10.97. As a result the IAF’ trades in old Gp I has become Gp X, old Gps II & III were merged and become Gp Y and the old Gps IV & V were merged and become Gp Z. Accordingly the Pay scales of Group Y and Z were revised upwardly(Group X’s remained unchanged). The minimum scale of pay of lowest rank/group fixed was - AC (Gp X) – Rs,3675/- (Gp Y )-Rs.3250/-, (Gp Z)- Rs.3050/- and their MINIMUM pension @ 50% of scale should have been Rs.1838/-, Rs.1625/- and Rs.1515/- respectively w.e.f. 10.10.97. But surprisingly pre-10.10.97 (Pre & post 1.1.96) PBORs retirees pensions were not revised as per new pay scales applicable to them, resulting in emergence of 3 PBOR categories PBORs i.e. Pre-1.1.96, Post 1.1.96/Pre-10.10.97 and Post 10.10.97, each with different pension rates. Also the orders of RESTRUCTURING OF GROUPS VIZ. X Y & Z w.e.f. 10.10.97 were not implemented on the plea that this POLICY IS NOT APPLICABLE IN R/O RETIREES OF PRE -10.10.97, AND THEIR GROUPS WILL REMAIN THE SAME (GROUP I TO V) FOR FUTURE REVISIONS",as clarified by AFRO New Delhi.
Furthermore, Sir, as sequel to the Hon. President’s (Dr. APJ Abdul Kalam) declaration during Republic Day Parade celebrations on 26.1.2006, the MOD had issued another order on 1.2.06 to IMPROVE THE PENSIONARY BENEFITS OF PRE-1.1.96 PBORs pensioners, envisaging interalia, a MINIMUM PENSION OF Rs.1913/-.(a 1.5 times increase over Rs.1275/-) (V CPC rate) and directed the authorities to comply. But sadly again, Sir, the MOST IMPORTANT CIRCULAR NO. 350 d/d 19.5.06 of PCDA Allahabad simply excluded the MINIMUM PENSION OF Rs.1913/- criteria envisaged in the MOD order. However, strangely a different and unrelated order of the GOI, issued in 2004 on the MERGER OF 50% DEARNESS PENSION and already in vogue w.e.f. 01.4.04 (in r/o all Central Govt Employees including Defence pensioners), was not incorporated, resulting in very low fixation of pensions (even lower than the existing ones) in r/o PBORs (Sepoys /Naiks/Havildar &equivalents) with service upto 20 years (Table Nos. 59 to 72 of Cir.No.350 d/d 19.5.06). Therefore, Sir, the very concern/purpose of the Govt of India/MOD to IMPROVE THE PENSIONARY BENEFITS TO PBORs of pre-10.10.97 was defeated per se. If these orders were implemented, the revised Minimum Pensions of the Lowest Rank/Group could have been – AC-Gp X-Rs. 2757/-(1.5 times of 1838), Gp Y- Rs.2438/-(1.5 times of 3250/-), Gp Z-Rs.2288/-(1.5. times of 1525/-). Moreover, the detailed guidelines and directing all the PDAs to revise/fix pensions or PBORs on their own and not to wait for instructions/Corr. PPOs from the Govt. have only added confusion. The net result, there is a total confusion and the PDAs have not yet revised the pensions of PBORs in terms of Circular No.350 D/d 19/5/06.
Consequent to the recommendations of 6th CPC, the MOD’s issued pension orders on 11.11.08 for revision of pension of PBORs of Pre-1996 (VI CPC) w.e.f. 1.1.06 with a criteria of “NOT LESS THAN 50% PAY AS MINIMUM PENSION “ for a “20 YEARS SERVICE” period. The 6th CPC had revised Minimum/Maximum Pensions to Rs.3500/-(by 2.745 times of Rs.1275/-(LOWEST) and Rs.45000/-)(by 3 time of Rs.15000/ (HIGHEST) ranks respectively(for Civilian pensioners) w.e.f. 1.1.06. But a Fitment Formula of 2.26 times increase over old pensions of PBORs or With Minimum 50% of revised Pay Scale/Pay Band, MSP (VI CPC) for 33 years qualifying service to earn pension was made applicable to them to be reduced pro-rata in case of less years of 33 years maximum service. The VI CPC had further revised the Group to X and Y only. With all these new changes, the PBORs pensions which were less and plaguing, have been further nose-dived/reduced to an astonishing low level.
SUGGESTIONS
(A) The MOD Order of 3.10.00/10.11.00 -Restructuring of Groups/Trades on Entry Qualifications w.e.f. 10.10.97 may be implemented for all Pre-10.10.97 PBORs retirees, and on the basis of the revised group pay scales. The Pension Provisions (@50% Min. pay scale of the rank/group) of MOD order d/d7.6.99 be implemented w.e.f.10.10.97(V CPC).
(B) The MOD Order of 1.2.06 which raised the bar of Min.Pen.of Rs.1275/-(V CPC) to Rs.1913/(VI CPC)(by 1.5. times) may be implemented w.e.f. 1.1.96 in r/o all Pre&Post 10.10.97 PBORs retirees
(C) The 6th CPC’s formula of revised Pensions of Rs.3500/-(Min)(2.745 times of Rs.1275/-V CPC) and Rs.45000/- (Max)(3 times of Rs.15000/- V CPC) of Civil Pensioners, may be modified to 3 times increase(in place of 2.26 times) uniformly on old Min/Max pensions and applied to all pre-1.1.06 Defence Pensioners (by amending the terms of MOD Order dated 11.11.08) w.e.f. 1.1.06 ).(Rs.1913/- by 3 times – Rs.5740/-at a minimum rate to lowest rank/group PBOR).
(D) A 100% or 75% (in place of existing 50%) MSP may be added as a separate entity, (SPECIAL TOKEN/PAY BACK MEASURE BY GOI) w.e.f. 1.7.09 to all PBORs retirees.
(E) Sir, presently, the Medical Allowance @Rs.100/-pm is granted to all PBORs living in non CGHS locations from the year 1997. Keeping in view the failing health conditions of PBORs retirees due to advancing of age/living in countryside and steep rise in cost of medicines / consultation fee etc. there is an urgent need for sympathetic consideration for an upward revision of the same. The Medical Allowance (non-CGHS category) to all PBORs may be enhanced to Rs. 1500/- pm, to meet ends of justice. .
2. In view of the foregoings, I earnestly request you Sir to kindly consider and order to set right and revise the PBORs pensions on the above suggested manner or other more beneficial method, since the Govt had taken cognizance of the malady and decided to redress, and initiated steps in that direction. This would surely go a longway in benefiting the entire community of PBORs, who shall ever remain indebted and grateful to you.

95th DEFENCE PENSION ADALAT at TIRUCHIY(TN)
1. All Veteran Ex- Army, Navy and Air Force Brothers may kindly note that the 95th
DEFENCE PENSION ADALAT will be conducted at TIRUCHIY(TN) in the First/Second
week of November, 09, as informed by the PCDA)P_ Allahabbad, and the details are
given below:-

As per the Annual Action Plan of Controller General of Defence Accounts, New Delhi in consultation with the Ministry of Defence, the Principal Controller of Defence Accounts(Pensions) Allahabad will be organising the 95th DEFENCE PENSION ADALAT at TIRUCHIRAPALLI(TN) in the First/Second week of November, 2009 for redressal of grievances of Defence Pensioners / Defence Family Pensioners / Defence Civilian Pensioners drawing pension through PUBLIC SECTOR BANKS, DPDOs and Treasuries in the State of Tamil Nadu.
Objective
Any Defence Pensioners / Defence Family Pensioners / Defence Civilian and their families having any specific grievances relating to sanction or disbursement of defence pension are requested to submit their representation, in writing, in duplicate , to :

A format of the representation is given on this website. Applicants are advised to apply as per the format, for easy processing of their applications.
Kindly Note
1. Applications can either be sent by post or by E-Mail
2. Two copies of the applications should be sent
3. Xerox copies of Pension payment order, Corr PPO, discharge certificate (wherever required) and other documents must be enclosed
4. Each application will be allotted a unique Adalat Registration Number. The same should be quoted in all future correspondence.
5. Individual call letters notifying the date and venue of the Adalat will be sent in due course
6. Incomplete and unsigned representations will be rejected.
The venue and date of Adalat will be notified in electronic and print media shortly.
TA/DA will not be reimbursed to pensioners/individuals attending the Adalat for redressal of their pension related problems.

Subject:- Implementation of Government Decision on Recommendations of Sixth Central Pay commission regarding pensionary benefits for Armed Forces Personnel below Officers Rank (PBOR) retiring or dying in harness on or after 01.01.2006./ Option for commutation of pension.

A copy of Government of India, Ministry of Defence letter No.17(4) / 2008 (2)/ D (Pen / Policy) dated 11.09.2009 regarding option for commutation of pension, which is self explanatory is forwarded herewith for further necessary action at your end.
2. The following vital points are as under:-
LAST DATE OF EXERCISING OPTION FOR COMMUTATION OF ADDITIONAL PENSION
The option for commutation of additional pension shall be exercised by the affected Armed Forces Pensioners with in one month of issue of Government of India Ministry of Defence letter No. 17(4)/2008 D(Pen/Policy) dated 11.09.2009 i.e. up to 10.10.2009 (under transmission)
DEEMED TO HAVE BEEN OPTED FOR OPTION 1
In case on option is exercised till 10.10.2009, the pensioners shall be deemed to have option for option 1 of the Ministry of Defence letter dated 27.11.2008, Annexure-II and his case will be processed accordingly.
Option 1 reads as under:-
"I...............Service...................No................./....................................Regimental No....................Rank...........................Name..................................granted pension in becoming due to retrospective revision of my Pay/Pension."
ACTION IN CASE NO OPTION RECEIVED UP TO 10.10.2009.
The claim for revision of pension/gratuity will be initiated by CDA(O), Pune in the case of Army Officers, Naval Pay Office in the case of Naval Officers and AFRO in the case of Air Force Officers and concerned Record Office in the case of PBOR.
OPTION / REQUEST RECEIVED AFTER THE CUT OFF DATE i.e. AFTER 10.10.2009.
Any option / request received from the pensioners after the above cut off date shall be treated as fresh application to commutation of additional pension. In such cases, a fresh commutation medical board if applicable would be required as per extant rules on the subject and age as on next birthday would be reckoned and accordingly to calculate commuted value of pension.
3. This circular has been uploaded on PCDA(P) website www.pcdapension.nic.in for disseminated across the Defence pensioners and PDAs.
